These Terms & Conditions ("Terms") govern your access to and use of our website, services, and telephone or electronic communications (collectively, "Services"). 2. Telephone & Electronic Communications
2.1 Consent to Receive Calls & Texts. By providing your telephone number, you expressly consent to receive non‑marketing and marketing calls, SMS and MMS messages, and pre‑recorded or autodialed communications from or on behalf of Borgen’s Construction Inc., its affiliates, partners, and service providers, including messages regarding project updates, invoices, promotions, and surveys.
2.2 Opt‑In Requirements. We will obtain your prior express written consent before sending any marketing calls or texts. Consent may be given via web form, contract, email, text message, or other lawful methods.
2.3 Opt‑Out & Revocation of Consent. You may revoke consent or opt out at any time by:
Replying STOP to any SMS/MMS message you receive from us (if you initially opted in via text).

Upon processing your request, we will cease marketing communications within ten (10) business days. Non‑marketing or service-related communications (e.g., contract notices, project scheduling updates) may continue as necessary to fulfill our contractual obligations.
2.4 Message & Data Rates. Message and data rates may apply to SMS/MMS messages; please consult your carrier for details.
3. Compliance & Limitations
3.1 TCPA Compliance. We adhere to the Federal TCPA (47 U.S.C. §227) and its implementing regulations, including honoring the National Do Not Call Registry and maintaining our own internal do-not-call (DNC) list.
3.2 California ADAT Law. We comply with California’s ADAT (Cal. Penal Code § 630–638) governing automated and prerecorded calls and ensure that no marketing communications are made without express consent.
3.3 Caller Identification. All telemarketing calls will display a valid caller ID identifying Borgen’s Construction Inc.
3.4 Recordkeeping. We maintain records of consent and opt-out requests for a minimum of four (4) years, in compliance with federal and California laws.
4. Intellectual Property
All content on our website, including text, graphics, logos, and software, is the property of Borgen’s Construction Inc. and protected by copyright, trademark, and other intellectual property laws.
5. Limitation of Liability
To the fullest extent permitted by law, Borgen’s Construction Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Services or communications, even if advised of the possibility of such damages.
6. Dispute Resolution
Any disputes arising under these Terms will be resolved through binding arbitration in Fresno County, California, under the rules of the American Arbitration Association, except where prohibited by law.
